What is Stalking in the Third Degree in NY?
In New York, Staking in the Third Degree, Penal Law Section 120.50, is a class A misdemeanor. Staking in the Third Degree either involves fear of the commission of certain crimes against a person.

Under the multiple offense provision of Stalking in the Third Degree, a person may be charged, even if they have not been previously convicted of Stalking charges, if he or she allegedly Stalks 3 or more people at three or more different times and places. Next, a person may be charged if he or she allegedly commits the crime of Stalking in the Fourth Degree and has a previous conviction with the past 10 years.
Finally, Stalking in the Third Degree may be charged if a person has previously been convicted of a predicate crime against the same person or their immediate family member in any state within the last 10 years.
The list of predicate crimes is extensive and includes Rape, Criminal Sexual Act, Assault in the Third Degree, Criminal Contempt for violating an Order of Protection, Criminal Mischief, any violent felony, among others.

Stalking in the Third Degree is a class A misdemeanor with a penalty of up to 1 year in jail. However, avoiding a criminal conviction altogether is if a person has no prior criminal history.
