Undocumented Construction Workers and New York Labor Law: Your Rights Still Apply

New York’s Labor Law Sections 240 and 241 do not ask about immigration status. They apply to all construction workers engaged in the covered work — regardless of whether the worker is documented, undocumented or in any particular immigration status. Undocumented construction workers who are injured on New York job sites have the same exact legal rights to full compensation as any other worker.

The Law Is Clear in NYC: Immigration Status Does Not Matter

New York courts have consistently held that immigration status does not affect a worker’s right to bring Labor Law claims. The statutes protect workers based on what they do: engaging in construction work on the job site. The laws are not based on who they are or what documents they carry. Employers and contractors who try to use immigration status as a shield against Labor Law liability are acting contrary to established New York law. That’s because undocumented construction workers have rights.

Undocumented construction workers can recover the same categories of damages as documented workers for their injuries. That includes medical expenses, pain and suffering and economic losses. Immigration status may affect how future lost earnings are calculated.
